China's reform and opening-up policy is accompanied by the suffering of anti-dumping investigation. The loss on anti-dumping has increased year by year. Therefore, the problem of anti-dumping has attracted the attention of Chinese government, enterprises and scholars, and the studying on that problem is still a hot topic.According to the statistics from the World Trade Organization, from the 1st January 1995 to the end of June 2006, the total number of the anti-dumping investigation on the Chinese export products actually was up to 353 cases, which amounted to 18.83% compared with the total number 1875 in the worldwide. China suffered the most anti-dumping investigation cases during this period. In the meantime, the U.S. was the second largest country which accused Chinese products of dumping for 51 cases, inferior to India. The two countries shared 19.83% and 14.54% respectively in the same period. Apparently, the U.S. has become a major launcher of dumping toward Chinese products. The main characteristics of the trade conflicts between China and America are high affirmative verdict rate and high anti-dumping duty rate. The verdict of high anti-dumping duty rate is mainly due to the Chinese enterprises' non-access to "Separate Rates".With the deepening openness of Chinese economy, many enterprises in China are not being controlled by government any more and have become independent business unit. In fact, faced the anti-dumping investigations, if Chinese enterprises can respond to them actively, they are totally able to acquire "Separate Rates" qualification. Based on this angle, this paper studies on the law and application procedure relating to "Separate Rates" in America, and analyzes the "Separate Rates" with the typical anti-dumping cases happening to Chinese products in American market, in order to help Chinese enterprises in anti-dumping practice and try to reduce the high anti-dumping duty rate resulting from the misplay in such activities.
