Coc Intellectual Property Management Mechanism Based On The Production And Research Cooperation Projects To Explore

CHAN-XUE-YAN integration means the cooperation among Industry (CHAN), University (XUE) and Research Institute (YAN), i.e., IURi. Technology innovation represents the urgent requirement and sustaining resource for the economic development in China nowadays; IURi collaborative innovation is one of the most important manners for technology innovation, and also an effective route towards creating core competence for the industry. A lot of difficulties are evidenced for IURi collaborative innovation today as there are big differences in strategic positioning, organizational goal and operational mechanisms for the three parties, among which the lack of effective intellectual property (IP) share system is difficult to make the common profits for the three parts and to stimulate the smooth operationg of the innovative system. The process of technology innovation, transfer and diffusion is also the process for IP creating, transfering and utilizing. Since a long time, IP management has been an unclear, unsolved problem in the IURi programs, which will strongly impede the smooth operation of the collaboration among the three parties, and will affect the sustainable development of the IURi collaborative innovation. With the development of the IURi cooperation, IP management will be highlighted in IURi program management and will top the whole management system.Based on current situation of the IURi in China, this work will first exemplify the collaboration of the Institute COC with industries, and study the documentation on IURi cooperation, IP share, IP functionalization; then from the Institute's view, to analyze the IP share system and the problems involved in the collaborative innovation between industry and research institute, emphasizing the IP creation, utilization and protection in this system; and finally using the theories and methods from IP management, contracts, program management, to propose corresponding advices, focusing on advancing the results and efficiency of the collaborative innovation, trying to improve the IP management system in IRi collaboration, in order to solve practical problems. The work was divided into the following 4 parts:1. The background, including practical and theoretical background, introducing the origination and models of IURi, the concept of IP, theories in program management, the relation between IP management and program management;2. Analysis of the current situation of IP management in the Institute COC;3. List of the main problems related to IP management in COC's IRi collaboration;4. Proposal for COC to set up IP management system in IRi cooperation.
