Research On The Legal Protection Of Film-work Internet Copyright

Film-works have published nearly 100 years, with the development of digital technology and new internet technology, the dissemination scope of film-works is expending, the dissemination spread of film-works is speeding up and the influence of the film-works to the modern life is increasing. However, the protection of film-work internet copyright is becoming today's most urgent issue, because the internet copyright torts have effected the development of film industry. Over the years, Chinese theoretical circle pays low attention to the protection of film-work internet copyright, which results weak ability of theory research and the low level of legislation and justice.The legal protection of domestic film-work internet copyright is researched in this paper basing on the status of our country's film-work internet copyright protection, the structure of legal protection system and the method of combining theoretical analysis and empirical analysis. In order to eliminate the legal dilemma and system obstacle, and provide more scientific and systematical legal system to film-work internet copyright protection.This paper, firstly introduces the definition and characteristics of film-works, analyzes the moral rights, economic rights as well as the ownership of film-work internet copyright; secondly, elaborates the theory and reasons of film-work internet copyright torts, the principal of film-works internet dissemination is separated into two categories, the video frequency websites and network users, their torts, tortuous liability and criterion liability are analyzed separately, and the related dispute theories are discussed; our relevant legal system on the film-work internet copyright protection is analyzed meticulously, the achievements and deficiencies of film-work internet copyright protection on the legislation, administration, jurisdiction, and self-reliant protection are definitely; some beneficial experiences are gained by analyzing occident and other countries'legal protection methods of film-work internet copyright; finally, the legal system of Chinese film-work internet copyright protection is researched comprehensively, basing on our own status, the reformation program and the arrangement of legal protection are raised from four aspects, such as the legislation, administration, jurisdiction, self-reliant protection and so on.
