Regulatory Detailed Planning Adjustment Causes And Countermeasures

Regulatory plan is a planning level with legal effects in China, the intermediate link that not only connects urban comprehensive plan (zone plan) with site plan, but connects planning and design with management implemented. Moreover, regulatory plan provides urban plan with direct basis, on which unban land development and constructive activities can be controlled. In the process of planning implementation, we are frequently faced with abundant applicant demands related with regulatory plan adjustment (amendment). Particularly, the interests of construction unit, project owner and unban residents, the scientificity of programming and seriousness of management are all involved in the adjustment of regulatory plan index, and it is a severe challenge to the statutory force of the regulatory plan. Therefore, promoting the reform of the regulatory plan index alteration appropriately is a necessity to carry out Law of Administrative Licensing.The thesis aims to carry out the research by way of documentary study, comparative induction, case study and systematic analysis. Starting from some specific theoretical and case study, the thesis attempts to analyze the general issues and underlying causes of regulatory plan as well as adjustment. At the same time, some suggestions are put forward that the procedure, demonstrative approaches and institutions should be adjusted in view of regulatory plan, which has an important practical value and innovative significance. The thesis consists of three parts according to the logic of proposing, analyzing and solving the problem. The first part deals with literature review. Based on reviewing the production and development of China's regulatory plan, the thesis bring forward the issue of regulatory plan adjustment after drawing some lessons from regulatory plan and adjustment research at home and abroad. The second part is a case that analyzes and studies on the causes of regulatory plan adjustment and the underlying problems existing in many sectors by way of differentiating the concept of regulatory plan adjustment, acknowledging its classification and administrative behavior. The third part elaborates some countermeasures and suggestions. After a detailed analysis of the causes and existing problems in the course of regulatory plan adjustment, the thesis brings forward a seris of reforming measures to solve the problems lying in the management of regulatory plan, hoping to be of great help to the development of regulatory plan and our practical work.
