Of China's Environmental Public Interest Litigation System

With the rapid development of modern industry and economics, it leads the environment to serious pollution and destruction; it has become a cosmopolitan problem that threatens humans' survival and development. However, as people gradually increase the awareness of environmental protection, it has become one of the most concerned issues in the 21^st century. How to coordinate the environment and economic development, and the establishment of harmony between nature and the world in general has become a topic of concern. Especially, Comrade Hu Jintao's report about the person, the nature and the environment at 17^th Party Congress, profoundly manifested that urgent attention was paid to our country environment protection problems by the Party and the Nation's leaders. But our country current environment protection mechanism can't reach its protection function, the event that destroyed the environment took place repeatedly, some more effective system to protect the environment must be set up immediately. The environmental public interest litigation takes the protection of the public environment as its ultimate goal; the environment public interest litigation can arouse people's positive participation in the protection of the environment mostly, so it becomes the people's first choice. Establish the environment public interest litigation system, not only the necessary guarantee for the establishment of a resource-saving and environment-friendly society, but also the necessary part of the environmental protection system of our country. This text joins together the reality of our country, as well as drawing on the advanced experience of foreign countries, provided some viewpoints of construction of the environmental public interest litigation in our country.In addition to the foreword and the conclusion, the text includes five chapters. The first chapter makes an outline for the basic knowledge of the environment public interest litigation, introduces its' theoretical basis and the function. The second chapter analyses the necessity and feasibility of the environment public interest litigation system, and educes the importance of the establishment of the system. Chapter three briefly introduces the development of the overseas environmental public interest litigation. The forth chapter analyses the actuality about country's environmental public interest litigation, and points out the existed defects. The last chapter is the most important chapter; it gives some advices for the China's construction of the system of environmental public interest litigation.
