Public Participation In Environmental Law System And Its Perfection

Since the 20th century, public participation has become popular. Governments, international organizations and environmentalists realize that public participation is very important. The public participation has been approved by international community as an effective environmental protection method. A lot of countries have set up the legal system of public participating in environmental protection. The market malfunction and the government malfunction phenomenon in the environmental protection still exists in china. The situation of Chinese environment is still not optimistic, it is still becoming worse and worse in whole. The public participation in environmental protection can solve this difficult problem effectively. As we know, the public participation in China is still not at a developed stage, this has a serious influence in Chinese environmental protection. Public participation plays a tremendous role in environmental protection, we should promote its development positively and prudently. We should make good use of the advanced experience from the other countries without separating from the Chinese national conditions.There are extensive theoretical foundations in the public participation and it has practical signification. In our country, public participation is in a small scale and lacking attention to the public participation in decision. There is no environmental public service lawsuit system. Non-Government Environmental Organizations (NEGOs) have weak strength. In this article, there are several suggestions for the improvement of legislation in public participation in China.
