Research On Issues Of Government Environmental Responsibility

In recent years, soil pollution、water pollution、fog weather accidents happenfrequently in some areas of our country, as defenders of the public interest, thegovernment should take the main responsibility in the environmental protection work.However, the implementation of government’s environmental responsibility hasexposed all sorts of problems: the current environment laws and regulations are toolimited to constrain the government’s environment behavior; the law which was lack ofoperability is not only incomplete but also too principle to standardize and restraingovernment’s environmental protection responsibility. The environmental protectionagency’s duty is not clear, the backward mode of law enforcement runs counter to thenew law enforcement idea, etc., these problems has hindered the construction ofenvironment-friendly society of our country and the realization of sustainabledevelopment. Therefore, under the situation, the study on the government’senvironmental responsibility legal issues research helps to prompt the government toactively fulfill their duties of environmental protection, to play the leading role ofgovernment in environmental protection work, to optimize the government’s lawenforcement concept, to improve the level of government’s law enforcement, andeventually realize the balanced and sustainable development of environment, economyand society.By analyzing the reason in theory and reality for strengthening government’senvironmental responsibility to illustrate the necessity and feasibility of strengtheningthe government’s environmental responsibility. Then respectively analyses the relevantprovisions of the government’s environmental responsibility and the current problems inour country, such as the current environment laws and regulations are too limited toconstrain the government’s environment behavior; standardize and restraingovernment’s environmental protection responsibility law which was lack of operabilityis not only incomplete but also too principle, The environmental protection agency’sduty is not clear. By further introduce the United States, Japan and Russia on thelegislation and practice of government’s environmental responsibility, and combinedwith foreign mature experiences to perfect our country’s government’s environmentalresponsibility, the last part is the core content of this article: to strengthen the legal countermeasures of government environmental responsibility, we should perfectlegislation of government’s environmental responsibility, strengthen the newenvironmental protection law of the operability and set environmental protection agencyscientific,at last optimize the effect of law enforcement.On the research methods, this paper mainly adopts law’s perspective to analyze thegovernment’s environmental responsibility, compare and summarize the legislation andpractice experience of developed countries, to strengthen the government’senvironmental responsibility measures in real operation.
