A Comparative Study On The Environmental Responsibility Of The Air Pollution Prevention In China And Japan

After the industrial revolution, the industry is developing rapidly, the people have poured into the cities. The industrialization and the urbanization brought many big cities serious air pollution. In the top 10 polluted cities in the world, seven of them are in China. Especially the air pollution caused by automobile already became the main source of the air pollution in the big and middle cities.Based on the above background, the issue of air pollution already became one of the difficult problems which cannot be evaded. Since various fields in the society make great point of the issue, Chinese government at any level also have continued to promulgate the related laws and regulations. "Law of the People Republic of China on the Prevention and Control of Atmospheric Pollution" already provides some clauses, for example the Air Pollutant Emission Control, the Air Pollution Discharge Permit System and so on. However the related laws and regulations still not enough to be called as functional. Especially in the field of prevention of automobile exhaust got off to a bad start and the related regulations have many problems.Refer to the related materials, China already became the top country of the manufacturing automobile in the world. It would admit of no other explanation that automobile exhaust became the main source of the air pollution in China. It is the main source of the dust and photochemical smog. Refer to the authoritative observation, air pollution in Chinese cities are composed of soot and automobile exhaust, what is called multiple contamination. It directly effects human health. Compared to the other air pollution sources, the feature of the law altitude exhaust of automobile brings human body the great damage. To prevent the issue of automobile exhaust from making worse, we must make a thing of controlling the air pollution of the automobile exhaust by taking law measures.In China many scholars research into dealing with automobile exhaust. The comparative study of inside and outside of the countries over controlling on air pollution already obtained a certain extent. However the studies of environmental responsibility over air pollution are not many.Since the roots structure of migratory pollution, are complicated, especially automobile exhaust, the subjects of responsibility are various kinds of many, for example, State, local autonomous, enterprise and consumer. However Chinese legislation over that field still exist ambiguous phrases, the subjects of responsibility are not clear. The related laws and regulations still not enough to be called as functional, there is no comparable law and regulations to. Moreover the present stage of controlling measure against automobile exhaust in China is still obscure and related legislation and the present condition of serious pollution of the automobile exhaust have not gone together, since in the field of controlling automobile exhaust and law measures are comparatively insufficient. Therefore, the issue of prevention of automobile exhaust pollution is the main term of the research nowadays.Through the common nuisance, Japan has accumulated a lot of valuable experience and lesson, for example, the theory of law, technique of legal action, remedy and so on. That who takes the environmental responsibility over migratory pollution such as automobile exhaust became one of the research term of environmental law. Japanese scholar Teranishi Shunichi insisted the idea of responsible commitment which is based on the responsibility of all related subjects. Japan has met with the issue of automobile exhaust while the economic was rapidly developing. Japan already have investigated and established the series of effective law system and measure by combining the actual circumstances and the law theory, and applying advanced technology and strict lawmaking.This research investigates into the prevention system of automobile exhaust in China, and combines it and the help of experience of air pollution prevention in Japan. At last, I propose my advice for the construction of automobile air pollution prevention in China.
