Of Civil Liability, Corporate Environmental Pollution

The company, acting as a main body of market economy, creates enormous economic benefits at the same time , the environmental pollution have become more and more serious. This paper is divided into four chapters on the company's pollution of the civil liability of this reality and urgent problem. The first chapter introduces two cheoretical basis of environmental pollution responsibility :"environmental right"and Japan's"tolerable limits theory".The second chapter analysises company environmental pollution responsibility elements of the composition and responsibilities of the special nature of the commitment .The third chapter analysis the two special issues of company environmental pollution responsibility:first, an independent legal personality abuse to refuse or avoid taking the responsibility of compensation for environmental pollution; second , bankruptcy company's commitment to environmental pollution responsibility. The fourth chapter introduce two systems: environmental liability insurance and environmental protection fund.
