| In recent years, there are more and more exchanges between China and ASEAN. Bilateral trade continues to grow. Cooperation has also been expanding. At present, China-ASEAN free trade area has been officially started. However, with the deepening of economic cooperation, environmental issues are also enlarged. This article will discuss the environment problems caused by human's activities and natural reasons. So the establishment of China-ASEAN free trade area environmental legal system can help us correctly handle the relationship between tradings and environment and correctly deal with the environmental issues during trading.In this article, the environmental legal issues of China-ASEAN free trade area will be studied. From the perspective of environmental law, a research method "ask questions-analyze the questions-solve the questions" is proposed..Besides the introduction and the conclusion, the article is divided into five parts. In the first chapter, China-ASEAN free trade area and environmental problems in free trade area are briefly introduced. The second chapter is a "problem-analyzing" part. The author analyzes the causes of environmental problems in China-ASEAN free trade areas. The third, fourth and fifth chapter is a "problem-solving" part. The third chapter puts forward the method to solve environmental problems with environment law. At present, the free-trade zone does not have a special environmental law. Now environment problems are solved relying on domestic environmental laws. It is not enough. So the establishment of environmental law is necessary in China-ASEAN free trade area. The fourth chapter studies environmental policies of the North America free-trade zone and the European Union free-trade zone. By analyzing the environmental policy of the North America free-trade zone and European Union free-trade zone, we can get a lot of experience which will be useful for the China-ASEAN free trade area. Finally, the author proposed to establish a special environmental law which has become the realistic demand that can solve the conflict in China-ASEAN free trade area. The fifth chapter is about how to construct China-ASEAN free trade area environmental law. By emphasizing the importance of environmental cooperation, the author puts forward her own ideas and suggestions for constructing basic theory, including the construction principle, the frame and the environment cooperation.The main argument of this article is how to correctly handle the environmental problems in free trade area. Just depending on domestic laws and multilateral environmental agreements is not enough. The establishment of a China-ASEAN free trade area environmental law is necessary. And the author puts forward her own opinions and suggestions about how to construct the environmental laws. |
