Since the founding of our country, it has established a series of environmental protective policies, but all of these did not achieve the desired effect. Because the government position on environmental issues biased. The role that government should play in environmental governance is the "referee" role, rather than the "players" role. New Institutional Economics think that the existence of environmental externalities lead to the failure of market mechanism in the environmental resource allocation, and the direct intervention of the government can only control the scale of environmental externalities but can't fundamentally eliminate the environmental externalities. The nature of environmental externalities is due to the unintelligibility of environmental property rights, thus, to internalize environmental externalities, and to achieve the optimal allocation of resources, we must make full use of resources in the configuration on the basis of defining the environmental property rights. Effective environmental governance in this way, the government should also assume the role of institutional arrangements. Therefore, the government's environmental functions should be changed in time, from the participants of the game to the game maker, and provide necessary protection for the environmental protection and management.
