The biggest obstacle of the marketing of rural collective construction land is due to incomplete rights bundles of land owners. Such defects are mainly embodied in empty possession of the property, the limited right to use, segmentation of right to derive benefit, virtual disposition, etc; Rural collective construction land are located in three kinds of ownership structure, which includs the township (town), village, groups of villagers tertiary structure, and each group owns management functions of construction land; In a limited supply of land system, the rural collective construction land should be how to break through the inherent binary segmentation and to obtain the same standards in the market to state-owned construction land; Theoretically, different ownership of land should flow "same place, same price, same right" principle, but China's current political system and legal mechanisms deny this direction, the state-owned construction land market still break away for the rural collective construction land; However, the farmers should have the land property, which must be derived from the support of a strong legal system, and which but also from driving force from economic construction and social development goals. Therefore, this paper from the economic dimensions analyzes various property income coefficient to different powers that belong to the owner of the construction land, and explain the practical significance of various factors, and still reflects "the power rent" which show the government's deprivation fo land property income. In addition, this article bases on this point of view from the national constitution, laws and regulations to find the identified basis for the property rights, finally to explore a path that is suitable to property rights trading market of rural collective construction land.In the binary division of the land system, rights trading of China's rural collective construction land property have great uncertainty; And because of the inherent nature of public ownership, it makes high transaction cost of the transfer of construction land, making rural collective construction land market running a non-optimal efficiency; All levels of government and all collective groups are also facing a very high monitoring costs, and purposely is to avoid possible rent-seeking behavior. Transactions of property rights of rural collective construction land is a kind of transfer which is non-reciprocal and not complete. due to three collective agency management, Farmer-owned construction land only go through the integration of effective property rights to be more efficient and intensive use of land. In the rural collective construction land market,the different behavior of people get different interests to pursue for. It must exist lingering relations among owners (farmers), managers or agents (collective), and the government; In rural collective construction land use right transfer market, due to the various collective varying degrees of defraud and violations of the rights from local governments, farmers as the main body of land ownership often lose a large part of property income as the first large group which is the poorest and the most vulnerable in society. Inconsistencies in target and selection of central and local governments, caused competing interests between them; however, both the result of game led to land system paradox.So a variety of issues derive from the government's system supply and political system.Reality tells us that, regardless of reduction in arable land or land idle, regardless property division between the state and the rural collective or public rights infringement of the private rights, regardless of the government's excessive levy of abuse or bullying of rural collective, the farmers has always been the true masters of the land, farmers has always been the most dire straits in society, the voice of the farmers have been able to reflect the truest reality.
