The Government Regulation In The Privatization Of Public Administration

Since the 1970s, a great reform of public administration privatization has been on the rise across the world. And private sector participates in the public administration affairs to some extent has been a global current. On the strength of more non-governmental institutions and relying on government less, deficiencies existing in the traditional bureaucratic government will be overcome. Hereby the varied and complex public affairs have been satisfied and better service will be offered. Meantime privatization is also one of the ways of China's economic and political system reform. Privatization requires response of the Administrative Law which regulating the public administration affairs, and requires regulatory intervention relating to privatization to ensure the fairness, justice, commonweal during the process of privatization. The thesis tries to probe into the government regulations during China's privatization of public administration and includes the following four parts:Part 1 is the Introduction part.Briefly introduces the research background, the main concepts, theories foundations and research status both at home and abroad of privatization and government regulations etc. Also this part brings the research design and methods of the thesis.Part 2 discussed the government regulation system of privatization both at home and abroad. The thesis takes two successfully reformed countries—Britain and America as examples giving introduction to their present government regulations, and highlights the main points worthy of learning. Then follows the summary of Chinese privatization process and current regulatory system and by comparing to find out deficiencies of our system in a general way.Part 3 mainly focus on the necessity of improving our government regulatory system during privatization. Due to the shortages and deficiencies of our system, many problems will probably occur. To avoid these problems and safeguard the smooth carrying out of privatization requires the government function transformation. And the government need play some crucial parts and regulate the public administration privatization.Part 4 based on the previous sections, this part further analyzed the shortages and deficiencies of our privatizing regulation system in drafting of law, organization structuring, scope definition, procedure setting, supervision mechanism and judicial relief etc. And put forward the perfect methods and solutions directed to every concrete problem.
