The Research Of Intellectual Property Rights Management Mechanism Based On Knowledge Transfer

With intense competition of the market,the competition forms of enterprises have become the knowledge of competition from the used capital competition. Intellectual property management is the fundamental way of enhancing or maintaining competitive advantage. Knowledge transfer refers to the knowledge spread from one resource body to another resource body,and then we can use and master this knowledge after learning. To maintain a highly competitive advantage,manager must take all of the measures to implement knowledge transfer within the enterprises. In the times of knowledge economy,knowledge transfer has become more and more significant. It will be an integral part of the intellectual property management. The relationship between knowledge transfer and intellectual property management is very close. On the one hand,only when the knowledge spread,mobile and transfer among the enterprises,the enterprises can obtain and share the knowledge,in order to enhance or maintain the competitive advantage;on the other hand,the dissemination of knowledge flow and transfer is also facing a critical risk of exposing the core of knowledge itself to other people,that is intellectual property risks. At present,few researchers have combined the study of the knowledge transfer with the study of the intellectual property management in-depth. Most of the researchers either study the theory of knowledge transfer (transfer mode,process,elements;transfer model;transfer mechanisms ), or only study the theory of intellectual property rights management (strategic management;system construction;building models,mechanisms). It is particularly important to handle the relationship between the knowledge transfer and the intellectual property management correctly. Handling the relationship between the knowledge transfer and the intellectual property management correctly,will bring the company with strong competitive advantage and great benefits in the knowledge economy era. Few people have studied the intellectual property management mechanism on the base of the knowledge transfer. This article will discuss this issue,mainly contents are as follows: The first chapter described the research background of this paper,domestic and international research on the knowledge transfer and the intellectual property management,research ideas and meanings of this paper.The second chapter described the relevant theories of the knowledge transfer(definitions,process models,the conversion of forms)and the intellectual property management(concept,content,function).The following research can proceed smoothly and deeply when we have a thorough understanding of relevant concepts and theories on the knowledge transfer and the intellectual property management. Therefore,this chapter is the cornerstone of the study paper.The third chapter analyzed the contents and tasks of the intellectual property management on the base of the knowledge transfer. At first,author analyzed the relationship between the knowledge transfer and the intellectual property management. Then,author analyzed the activities of the knowledge transfer in the intellectual property management. Thirdly,author analyzed the differences between the intellectual property management and the intellectual property management based on the knowledge transfer by the comparison of the content,features and tasks.The forth chapter analyzed the factors of intellectual property management based on knowledge transfer. The author classified the factors into three groups. They are:the macro-environmental factors(social legal environment,economic environment,population environment,culture environment,technology environment);in view of environmental factors(the competitive environment where enterprises are,the development of the industry of the intellectual property service,the demand of market);micro-environmental factors (corporate culture,organizational structure,technical support,human resources,intellectual property awareness).Finally,the author analyzed the interaction of these different factors. The fifth chapter is the core content of this paper. In this chapter,author has build and improved the intellectual property management mechanisms based on the knowledge transfer.They are:legal policy mechanisms,organizational structure mechanisms,educating and training mechanisms,knowledge dissemination mechanisms,warning and protection of the intellectual property,invention mechanisms and the transformation mechanisms. Finally, author analyzed the relationship among various mechanisms in-depth.The last chapter described the innovation of this paper. Author also summarized the paper at last.Through the above discussion of chapters,author has established and improved the intellectual property management mechanisms based on the knowledge transfer after the analysis of the content,tasks and factors of the intellectual property management based on knowledge transfer. In the knowledge economy era,the intellectual property rights is increasingly important on economic growth. It has been seen as an important tool for the development of economics. It has been the commanding heights of the international competition. Building scientific and systematic intellectual property management mechanisms is particularly important for the enterprises. The author's proposal can accelerate the construction of intellectual property management system. The author's proposals also guide the construction of the enterprises' intellectual property system actively.This paper has the innovations as follows:(1)Author analyzed the relationship between the knowledge transfer and the intellectual property management in-depth. Author analyzed the activities of the knowledge transfer in the intellectual property management from two aspects.(2)Author analyzed the differences between the intellectual property management and the intellectual property management based on the knowledge transfer by the comparison of the content,features and tasks.(3)Author analyzed the factors of intellectual property management based on knowledge transfer from three aspects(the macro-environmental factors,in view of environmental factors,micro-environmental factors). What's more,author analyzed the interaction of these different factors. Author has build and improved the intellectual property management mechanisms based on the analysis of the factors. The mechanisms are:legal policy mechanisms,organizational structure mechanisms,educating and training mechanisms,knowledge dissemination mechanisms,warning and protection of the intellectual property,invention mechanisms and the transformation mechanisms. Finally,author analyzed the relationship among the various mechanisms in-depth. Generally,few researchers have combined the study of the knowledge transfer with the study of the intellectual property management in-depth. The paper can accelerate the construction of intellectual property management system and guide the construction of the enterprises' intellectual property system actively.
