| FIDIC Conditions of Contract is more and more known in China, but there are not so many persons who actually dealt with it. What shall be paid attention to in the practice, how to manage the contract with FIDIC philosophy, how to manage an international civil engineering project and be a project manager? This thesis will study the FIDIC Conditions of Contract for Construction in combination with the related cases, and answer the above questions.FIDIC Conditions of Contract summarizes, over the last century, the experience of the construction and management of civil engineering works all over the world and the experience of international contracting. It integrates the aspects of the technique, management, economy and law in connection with the civil engineering construction and is standardized with contract conditions. It fairly stipulates the responsibility, obligation and right of the both parties in the contract with a precise and workable procedure. It is therefore internationally recognized and is mandatorily adopted in the management of the works funded by World Bank, ADB and foreign government.This thesis studies in combination with the cases the key points in the 20 clauses of the General Conditions of FIDIC Conditions of Contract for Construction 1999 version, and states the issues which shall be paid attention to by the Chinese contractors.This thesis introduces the information of the project"Port Arabia– Phase 1– Marine Works"and summarizes the ways of success for this project, including successful main contract management, successful procurement management, optimization of construction method, enhancement of productivity, excellent project culture and engineer's fairness.This thesis introduces the cases related to the issues which are considered be difficult by the Chinese contractors, including working relation with the employer and engineer, price negotiation during variation, adjustment, time and cost claim, etc., and provides some suggestion.Finally, this thesis proposes some philosophy of the international project management, i.e."fundamental of contract management","harmonious objective","cooperation between engineer and contractor","things in record","change of thought", etc., concludes that the engineer is the contract administrator and also the contractor's partner, exchanges the technique of contract management, summarizes the requirement for contracts manager, and states the Chinese contractor shall enhance the capability in connection with the management of main contract and procurement. |
