Research Of Problem In Financial Business Method Patent In The Banking In Our Country

After China joining in the WTO,finance industry will open to the outside world completely.It is obvious that the competitions between Chinese banks and overseas banks will be fierce.One of the magic weapons for overseas banks is to provide mature financial innovative products.Business method patent is the best way to protect financial innovative products.It is the kind patent that connects the rules of the general business and management to the information network technologies and software and hareware of computers.The research of financial business method patent is a prevailing topic in China.Most of current researches exist many drawbacks,and affect the objectivity of the research.This paper mainly divided five parts to research financial business method patent in our banking. Firstly it introduced the content of business method patent, and on this basis established a theoretical framework of banking financial business method patent, elaborated on banking financial business method patent and introduced the research tools——patent map; then it analyzed the current situation of patent of invention in banking;next used the latest patent data for analysis through the patent map, and found that our banks had raised awareness of the protection of financial business method patent ,that the number of financial business method patent in domestic capital banks was more than foreign capital banks and the capability of independent innovation become stronger ;but at present our banks existed some problems in developing financial business method patent, such as low quality, unevenness and not focusing on research prominent and so on; finally gave some suggestions from four directions to develope banking financial business method patent in our country。...
