Study On Legal Protection To Petroleum Resource Security In China

Petroleum resource is an important guarantee for national security, economic development and improvements of people's material living standards. Almost all the countries in the world put petroleum security on a significant place as in their's energy security and national development. In the Theoretical circles, petroleum security has not yet come to a unified definition. As China definites it as: the condition or capacity of a country or region to obtain petroleum resources sustainedly, steadly, timely, adequately and economically. Petroleum security should include three levels as supply security, price security and the safety of the environment. The petroleum security in China and the world are all in worried conditions, and countries have attached great importance to it. Through establishment and protection of the legal system is an effective way to improve petroleum security. China's the status of security legislation of petroleum resource is not optimistic: the energy legal system has not yet been established, the basic law of energy is absent; the institutions of petroleum resource security is not perfect; lack of effective system of government management; petroleum reserves legal system is blank, etc. And yet in such a background, the writer believes that the study of petroleum resource security in the legal protection is particularly important. And think study it has a professional significance in the fields of environment and resources. In this paper, the writer had a deeper exploration and research on further improvement on the legal protection of the petroleum security of China.This paper is divided into five main parts. The first part is on the definition of the petroleum resource security and introduction of the basic elements of it, then the status quo of petroleum resources security of China and the world. The second part discussed the theoretical basis of the petroleum resource security which explained the theory of sustainable development, the theory of resource security and established the foundation for legal protection of the petroleum resource security. The third part of the paper studied on the legal protection of foreign petroleum resource. The United States, Japan are selected as samples, two developed countries which have quite well perfect legal systems on petroleum security, as well as India, a developing countries with some same national conditions to China. By expounded the legal systems of the sample countries detailedly, the writer summed up the references on petroleum resource security legal protection of China. Part four of the paper focus on the study of the present situation of domestic petroleum resources security legal protection of China, and makes the evaluation. The fifth part is the critical part of the paper, which mainly discussed the suggestions in consummation on legal systems of China's petroleum resources safety. And the writer analyzed the petroleum security legal protection from three layers: the goal of the legal guarantee of petroleum resources security, the guidelines, as well as the specific systems, and gave her own point of views and recommendations.
