Energy sources are strategic resource,the important material foundation of constructing easy society roundly,and it ensures the sustainable development of economic society.Since the reformation and opening,we gained great achievement in development of economic society,but we also paid great cost in energy sources and environment. The truth that the extensive mode of economic increase,high consumption of energy sources,great waste and pollution of energy sources made the supply of coal,oil,electricity,transportation fall behind the demand of economic development.Our energy sources can not support the extensive mode of economic increase any more,so energy sources' restriction to economic development has become more and more obvious.The effective supply and saving of energy sources has become the key of continuance and speediness development of economy in China.Shanxi is a province rich in energy sources and consumes much energy sources,but the rate of utilizing energy sources is only 25%. Shanxi province's economy level works stable and speedily,but there exists following problems from the angle of scientific development and the long range coming objectively:the comprehensive utilization rates of energy sources is low;the conversion and process of energy sources is backward in technique;energy environmental pollution and ecocide is serious.Besides,maximal obstacle facing our country and Shanxi Province's energy conservation job is that the law guarantee is insufficient:(1)Our country's supporting system of energy conservation law and regulation is extremely not perfect;(2) our country's Constitution does not make the energy conservation legal status clearly,so that the legislation orientation of energy conservation law insists to hang down;(3)The maneuverability of current energy conservation law is not good;(4)It exists the phenomena of coyoting of Shanxi Province' coal resource and disorder construction of the sources of energy field,it lacks branch law and regulation,technical norms,energy conservation check mechanism of the relevance industry field on energy conservation.Analysis is indicated,one aspect is high speed increases of economy "being eager about" the sources of energy,another aspect is the national and province conditions that relatively short-supplied of the sources of energy,and the current situation that energy conservation law and regulation ensure insufficient.All these make the contradiction that the sources of energy restrain in feasible macro-economy operation outstanding.These signals in economy circulations demonstrates that we must take "constitution","Environmental Protection Law" as basis and perfect the energy conservation legislation that adapts to our national and Shanxi Province condition as soon as possible.We must improve relevant supporting rules and regulations,build an economy type of society,make great efforts to gain maximal economy and social benefits with the fewest sources of energy consumption.Therefore,the article have home and abroad scholars' studies about the energy conservation theory in mind,integrate with "Law of the People's Republic of China on Economy of the Sources of Energy "," Manage way of vital unit in energy conservation ","Shanxi Province energy saving regulation" and the Shanxi Province's law job practice on energy conservation,according to the jurisprudence analysis on energy conservation and the law's guarantee mechanism to energy conservation, draw useful experience in abroad energy conservation legislation,discuss the vacancy and deficiency of energy conservation law job in our country and our province,bring law's directive function in energy conservation into play furthest,Suggest that specially:(1)the scientific legislation, building-up and improving a legal system on reducing the consumption of energy and combating waste;(2) the pattern that "control total quantity target + pull triple structure + three-dimensional system adjusts";(3) introduce the system Shanxi "the commonweal lawsuit of sources of energy's wasting";(4) building that government's energy conservation dominates policies and measures,seeking a energy conservation road that there must be laws to go by,measure is proper,guarantee effectively.
