Social enterprise is not a business or social services.With the international economic "globalization",the power of state and government has become weakness.Beyond the traditional concept of corporate responsibility and image,multinational companies and enterprises have become more rights in the recent decades.Enterprise's economic growth leads to social enterprises have abilities to expand the scope of activities,become a new force for regional economic growth and increase their impact on society.With the emphasis on the production and non-profit "social entrepreneurship" of social enterprises,they play an important role in the economic redistribution function.Thus,in the establishment and operating process,they should be bound by legal norms.At present,the definition of "social enterprises" is different in various countries and some countries have no "social enterprise".What the legal form to apply in the social enterprises? In social practice,the aim for social enterprises is "social goals".Running in term of business commercial model is generally acceptable and recognized internationally.In China,running social enterprises is still a new thing.Its development and law regulations have no concrete control and it still a long way to have legal identities and provide appropriate lenient policies.The thesis is viewed from the completion of China's legislation of social enterprises,the general theory of social enterprises,current overseas development and legislation,China's recent social enterprise development and its incompletion of legislation.To conclude,the complete legislation for social enterprises in China(Mainland) is compulsory.
