Research On China's Legislation Of Coal Resources

The coal resource, important energy minerals in China, is regarded as a material basis of national economic and social development. In recent years, the exploitation type of plundering cause enormous waste and destruction to natural resources and environment, which is a threat to national energy security and brings possible risks for economic development and social stability. Among the social control systems of coal resource and environment protection, law characterized by stability, authority and compulsion should be the most powerful one. However, a number of problems from the present legislation system and concrete legal system make the system imperfect. The thesis holds that the obvious shortages in coal legislation make it difficult to regulate the complicated interests relations which is resulted by exploration, utilization, protection and management of coal resource and prevent the tendency of rapid and continuous reduction of coal resource and increasing deterioration of mining area's environment. Clearly, it is an urgent task to improve the legislation of coal resource, set up a scientific legislation system and reasonable legal system.By looking through current law involving coal resource, the thesis macroscopically analyzes present legislation system of coal resource and microscopically analyzes major legal system, attaches importance to the main drawbacks of coal resource legislation. Based on introducing successful experiences of foreign countries about legislation system construction and concrete legal system design of coal resource, the thesis mainly explores how to construct local legislation system and legal system of coal resource that will be scientific and suitable for China. The study, making an effort to avoid traditional logic of most scholars, namely, to focus research on concrete legal system and neglect whole legislation system, tends to examine the current problems of legislation system of coal resource from more perspective, hoping to improve concrete legal system on the basis of straightening out legislation system. During the study, the author tries her best to combine macroscopic exploration and microscopic analysis, connect international eyesight and local experience and lay stress on construction of legislation system and improvement of concrete legal system.The thesis attempts to adopt inter-disciplinary method (such as qualitative analysis and criterion analysis) and multi-disciplinary means (such as new systemic economics and management science) to broaden eyesight. The exploration of coal resource legislation system of China in the study has not been touched by other scholars, the research of concrete legal system in the thesis is more systematical and profound, hoping that the study can provide general logic for the coal resource construction of legislation system and improvement of legal system in China.
