The Research About Adjustment Of Land Property Right And Distribution Of Benefit In Farmland Consolidation

In the past years the demand of land resource has increased rapidly along with the faster urbanization and industrialiszation. To protect the basic farmland effectually and stabilize the land area, the former Land Management Office brought forward formally "Total Dynamic Balance Of Cultivated Land" aim, so land consolidation emerged as the times require. As an effective method of promoting land utilization, adjusting land use structure and relation, land consolidation has played an important part in the rational allocation of land resource, increasing cultivated land area, improving land-use efficiency and entiroment. But as the modern land consolidation is still in the initial step, its theorical research and programming practice is also defective, a series of problems about have occuered in practice.On the background of the government's enhancing protecting rights and interests in land consolidation, the paper bases on the relational basical theories about farmland consolidation. It analyzes the rights and interests' protection in land consolidation legislation on the one hand, discusses the land right plight and common problems of benefit distribution in farmland consolidation on the other hand, finally makes corresponding suggestions.The paper consists of five parts:The first part introduces the retional conception and theories: defines the conception, identities and modes of farmland consolidation in paper; introduces the theories of Sustainable Development, land economics, land property right, game and Equilibrium of interests.The second part is the practice of exotic arrangements for the rights and interests' protection in farmland consolidation legislation. On the base of introducing the legislation of farmland consolidation in Taiwan and foreign countries, the paper discusses the trait of their legislations: the standardization and legislation of rights and interests protection, regarding Ecological Effect. It also concludes the experiences fromo their legislations: set up the system of farmland consolidation legislation, attach importance to entironment protection.The third part is the research about land property rights adjustment analyse in farmland consolidation. This part analyzes a series of land property rights detailedly which consist of ownership, use right, income right, punishment right.It also discusses the connotation, pattern, principle and method of land property rights adjustment. Based on these, it makes the conclusion: the ownership is ambiguous; the use right is unsteady; the punishment right is limited; the income right is in defect of safeguard.The forth part is the theoretical research and empirical study on benefit distribution in farmland consolidation. This part contains two aspects: (1) the game analyses of benefit distribution in farmland consolidation. Based on defining the connotation of benefit in farmland consolidation, it analyzes the process of game among the interest subject and set up game model and finally makes the conclusion that whether the game realizing balanced interests depends on whether it can avoid the alienation of policy, rent setting and rent-seeking.(2) empirical study. It introduces the adjustment of land poperty righ and distribution of benefit in the land consolidation item of DaFeng city, JiangSu province. Through the introducing it discusses the common problems of benefit distribution in farmland consolidation: the economical income is ambiguous before distribution; benefit distribution is unbalanced; after distribution the effect feedback mechanism is lost.The fifth part is about the corresponding suggestions: clear and perfect the farmland property rights, set up benefit mechanism and pefect laws and regulations in farmland consolidation.
