Research On Construction Of New Regulatory Regime On Telecommunications Industry In China

Telecommunications industry has been China's economic development from the constraints of the "bottleneck" and promotes a national economic growth, structural upgrading of the pillar industries and enhancing the overall national strength of the strategic industry. Since reform and opening up, China's telecom industry development made great progress, the telecommunications regulatory mechanism has continuously improved and achieved great results, but still the community was questioned and criticized, and the basic model and core values has been unable to meet the development of the industry Necessary, unable to maintain the broad masses of people, especially the interests of telecommunications users. Therefore, establishing a centre for telecommunications users, the market environment for the new telecommunications regulatory regime is imperative.The thesis is concerned with mechanisms of the governmental supervision of telecom business, based on fruitful practice. In addition, it narrates the development and current situation of telecommunication industry in China, and compares some characters of supervision system in some countries with others,adapting the methods of comparative induction and combing theory with practice. Furthermore, the thesis quotes the theories of public goods and public choice, in order to research governmental supervision of telecom business in China.The thesis also analyses advantages and disadvantages of Chinese supervisory mechanism on telecommunications industry based on lots of data, using modern theories of competition law and applying case study, with qualitative analysis and quantitative analysis. The prevalent regulation is beneficial to the development of Chinese telecommunication industry, and harmful to the industry by oligopoly, imbalance of customers and enterprises, and insecurity of telecom network. On this basis, the article profoundly reveals the existence of the current telecommunications regulatory regime legal vacancy, its location is not clear, means a lack of supervision, monitoring institution-building lag, and so on.On this basis, this paper, the creation of a new telecommunications regulatory mechanism, put forward a basic framework of the system, and to telecommunications law promulgated as an opportunity to institutionalization, standardization; comprehensive use of the economic interests of regulatory and incentive theory, administrative law principles and rights relief principle, from various angles for the construction of a new mechanism to provide the support and protection system, its main contents include the diversification of the telecommunications regulatory objectives, basic principles, the scope of regulatory functions, management of the industry means elements.
