Study On The Policies Of The Land Exproriation And Housing Removal

With the development of the economy society and the acceleration of the urbanization, the size of a city is growing fast, it is necessary to expropriate a great deal of the rural collective-owned land. The process involves a lot of the farmers' houses removal and the appurtenance on the collective-owned land. From 1999 to 2007, there had been many houses and appurtenance on the 10 million square meters to be removed yet in Ningbo. But with the promoting law-based administration, especially after Law of Real Right went into effect as of Oct. 1.2007, the land expropriation and the housing removal is becoming the focus of the social public attention and the difficulty of the administration. How to develop the rural economy in accordance with the city's and improve the building up of the comparatively well-off society, which has become the most important thing in reference to the benefits of the farmers and the social stabilization and economical development.Although there have been some administrative regulations about the state-owned land expropriation and housing removal made by the state, but the state still has not made some special laws or administrative regulations to regulate the collective-owned land expropriation and housing removal. Ningbo made a local regulation about the collective-owned land expropriation and housing removal early in 1995 that was the first local regulation in our country's history and modified again in 1999 and 2006. Beginning with the present policies of Ningbo, combining with Law of Real Right, some spirits of the policies in this area home and overseas and the investigations and researches of the feedbacks from the administrative organs , the policies' performers of the land expropriation and housing removal and the farmers losing land, this article wants to indicate its flashing point and its deficiency, so that the administration will improve and modify its policies in a proper time in order to protect the interests of the farmers and in favor of the urbanization.Since August of 1997 till now, I have been working on making local-laws and administrative organizations in the Legislative Affairs Office of Ningbo Municipal People's Government, and been taking part in the drafting of more than 40 local laws and administrative regulations, such as Regulation of Ningbo Municipality on Collective-owned Land Expropriation and Housing Removal,Implementing Detailed-rules of Regulation of Ningbo Municipality on Collective-owned Land Expropriation and Housing Removal and Implementing Detailed-rules of Housing Removal in City, etc. I have done some studies and researches on the policies of the housing removal.
