Research On The Relationship Between Anti-dumping Rules And Competition Policy Under The Framework Of WTO

The Rules of Anti-dumping were born in the early 20^th century. The initiate legislative intention of the Anti-dumping Rules is to fight against the price discrimination in the international trade field and maintain the free and fair order of international trade. The Anti-dumping Rules can be easily abused by some countries because of the deficiencies on their legislative target, assessment criterion, etc. The Anti-dumping Rules have become an instrument of trade protectionism in practice. Some schemes have been put forward by international organization to reduce the negative effect on fair competition of Anti-dumping Rules.The purpose of this thesis is to discuss the relationship between Anti-dumping Rules and Competition Policy under the Framework of WTO. The first part introduces the history of foundation and development of Anti-dumping Rules and Competition Policy. Then I try to analyze the latent reason of their conflicts. The second part discusses the links and conflicts of Anti-dumping Rules and Competition Policy. Firstly, it analyzes the interaction relation on the scope of regulation, effective performance. Secondly, it introduces the conflicts of social value, target of protection, specific stipulations, etc. The third part discusses four schemes put forward by jurisconsults and economists, including using competition policy instead of anti-dumping rules or cancelling the anti-dumping rules completely or constitution of "Trade-related Antitrust Measures" or enriching and improving the anti-dumping rules by using competition policy. I try to analyze the advantages and disadvantages of each scheme and put forward some realistic solution methods. Some tactics for our negotiation in the area of trade and competition policy will be employed in the fourth part. The competition regulations should be utilized in the improvement of national and international anti-dumping rules.
