Research On System Of Environment Liability Insurance

The environmental liability insurance is one kind of liability insurances. People who engage in the activities of insurance business leading to the pollution of the environment should bear the responsibility of compensation or management. It's also one kind of social system of environmental damage compensation. It has the functions of dispersing risks, promoting development of economic and social stability. With the environmental violations accident occurring and the public awareness of environmental pollution rights, the Western countries have already formed a relatively mature environmental liability insurance system. Environmental liability insurance-related legislation involves only in certain areas, and the practice of environmental liability insurance is extremely rare in China.This article analysis the connotation of the environmental liability insurance, introduce its foreign and domestic history and development , discuss the relationship of the environmental liability insurance system and its related laws, from two aspects including the environmental liability insurance and tort law, insurance law. Meanwhile, the article studied environmental liability insurance system of the abroad, compared the system of the United States, Germany and France. The comparison of several different countries of the environmental liability insurance system provided theoretical support for the establishment of environmental liability insurance of our country. The construction of environmental liability insurance system of our country is mainly from two major aspects. First, it includes the selection of the model system. Second, it is the design of specific systems, including the setting of underwriting agencies, the scope of liability insurance, the setting of types, the accounting of premium rate, the aging of the insurance, the limited of the amount of claims.Environmental liability insurance system has established in every country and it becomes a trend. It is the right time that establishes this system in China. Under the guidance of the theory and the outstanding experience from abroad, in accordance with the national conditions of China, construct environmental liability insurance system of China.
