With water resource,especially drinking water,becoming shortage, study of water rights system attracts more and more attention. The Water rights system, in fact becomes one of the important highlight in resource and environmental economics.Following the increase of economy development and population, the water consumption quickly increases. Additionally the qualitative pollution that makes Guangdong that is one of the rich water resource provinces in China felt tension of water consumption. Those areas strongly demand for high quality water resource.Heyuan City is one of typical mountainous areas in Guangdong province, which drops behind its economy, while it is one of the richest high quality water resource areas in Guangdong. Heyuan has supplied water resource freely for other areas because of unclear water rights, and the Xinfengjiang reservoir water resource that is the highest quality and most sluice quantity in Guangdong haven't utilized in reason for a long time.In this paper, the water resource situation and the necessary and pressure for water rights innovation is analysed. Using the economics methods especially the property rights theory, transaction cost theory in the new institutional economics, the game theory, cost-benefit method in mainstream economics and optimal method in mathematics, the water rights of Xinfengjiang reservoir is analyzed systematically from the original water rights, reallocation rights, estimation of water rights value and the management and go on, then the relationship between the development and water rights is summarized, the policy suggestions is given out for Heyuan's sustainable development.It is concluded that: (1)The situation of water resource shortage in Guangdong especially the Pearl River delta is threatening safety of residents'water consumptions in these areas. The protection enthusiasm to water environment is hard to maintain because of unclear water rights, which makes the water innovation become necessary and pressure.(2)The water innovation is one of the most optical methods to decrease lost of resource allocation. The point to water rights innovation of Xinfengjiang reservoir is allocated the water rights according to a reasonable model, confirms the host, quantity and the rights in the beginning, then considers building two markets for water rights and emission rights in order to obtain a win-to-win between economy benefit and environment benefit in the reallocation period, and the economy value of water rights will be achieved in the bargainers'rational choices.(3)The water rights must be a rights to make anybody benefit or suffer on the base of public ownership in our country. In present, the key of water rights confirmation is to confirm the host, quantity and the rights categories.(4)The development foreground of Heyuan is the water rights innovation, and the broken point is the water rights innovation of Xinfengjiang reservoir.(5)The economy benefit and environment benefit will be obtained through building the combined market of water rights and emission rights. The emissions rights tradition can attain the aim to adjust the water quality.Included in the main innovations of this paper are(:1)water rights theory and the Xinfengjiang reservoir experience are combined, leading to the advancement of a allocation model for the Xinfengjiang reservoir water rights;(2)a assume is put forward to build the combine market of water rights and emission rights and the condition to achieve the target;(3)It is advanced that the water rights value is implemented through the market trade.
