Study On The Responsibilities Of The Government In Labor Relationship Regulation Process

Labor relations is the basic social relations in maintaining human society' s survival and development. Harmonious and steady labor relations is the important basis to build a harmonious society. So the issue of Labor relations is always the focus in the academic field and the government circles. We must construct harmonious and stable work relations in order to construct a harmonious socialism society.After more than 20 years of the reform and development of the economy and the society, the socialist market economic system has been already gradually established in our country. The economy ingredients of the society, the form of organizations, the way of employment, the form of assignment and the benefit relations diversifies day by day, the main body structure of work relations, the status of main body, the benefit of main body, the standard and the way of adjustment, the disposition way of labor force had been profoundly changed. There's no doubt that studying these changes, grasping its characteristics and its rules, has vital significance for constructing the harmonious work relations and the harmonious society. At present, how to construct the harmonious work relations is not only the focal point of the whole society but also the hard difficulties needed to be solved for the government.We must analyze carefully the labor relationship characters of this period, use international experience for reference, thus we can build a kind of harmonious and steady labor relations. So the research object is against this background.The full text were divided into four parts as follows:The first part of this article defines the work relationship and related concepts, makes a introduction the characters and the problems of labor relations in china at present.In the second part, the article studies the foreign regulation mechanism of the relation between laborer and entrepreneur, and makes an analysis of regulation measures and referential significance to our country on the basis of explaining the foreign regulation mechanism.The third part of the article analyzes the function and status of governments in harmonious working relationship construction , makes an analysis of the role of our government,the responsibilities and the main problems in modifying treatment, and illustrated the causes that problems taking place frequently in modifying treatment.In the forth parts of this article, the author proposed some counter measures and some suggestions. For example, legal framework of labors supposed to be perfected, and our governments should improve regulation mechanisms and establish the tripartite consultative mechanism etc.Both sides of the work relations are a pair of contradictory bodies, they contradict and unify mutually. The governments should defer to the principle that "the both sides bilateral coordination independently, the governments only present great regulations", and jumps from the chess playing of both sides of the labor, and draws back from some nonessential administrative intervention, takes on the role of referees and the benefit' s represents of the entire society. In the policy making time, the governments must follow a basic principle which is to curb the strong and to help the weak, and to keep the bilateral balance diligently.
