The regulation of urban land purchasing reservation, as a novel type of land administration rule, is the product of the development of the reform in the regulation of land use in China as well as the growth of land market. At present the regulation of land purchasing reservation has been widely put in to practice in different cities which makes it a hot issue in both land market and management. The regulation points out a new direction for land administration rules representing innovation in regulation construction.The implementation of the regulation realizes the intensive unified management of the government which protects the land ownership of the government and benefit the state-owned enterprises and the land market. However, the regulation is still in its starting stage with many details to be improved in concrete operation, including the nature niche of the act of land reservation, the choice and construction of the operational modes of land regulations and associated legal support. Therefore an issue of great significance has come in front of the academic field involved to the extent that how to have a better understanding of the regulation and improve it.The article attempts to explore the legal support for land purchasing reservation on the basis of the review and reflection on the practice of the development of the regulation of urban land purchasing reservation. The discussion is directed to the legal loopholes.The author begins with the origins of the regulation and then discusses the content and the practical significance. The operational modes and procedures of the present urban land reservation are discussed through experimental and contrastive analysis in the followingpart. The results of the analysis are employed to summarize the legal loopholes in the implementation of the regulation. The regulations of land purchasing reservation in other countries are examined, which holds implication for the regulation construction in China. At last, the author intends to construct the legal frame for the regulation and the related policies to ensure the healthy development.
