The 22th item in the third part of The Fisheries Amendment Act 2000 prescribes realizingly that"Set the TAC and carry out the quota-based management stage by stage follow the principia that the catches were limited to the increase of fishery resource. The mainly management department of fisheries is responsible for the stock assessments in order to make the reformation can go on wheels…."This policy is exciting, because leastways it shows that the government has determined to introduce the out-put control management in the fishery.However, 8 years passed, the policy has not been put in practice by now. May be the government is restricted by the fishery situations in our country, but we do not know the reason seriously. Obviously, there are many special problems with the fishery in our country compared with the others which had transformed their fishery management systems in to QMS successfully. For example, the fishing population is multitudinous, the target species are diversiform, too many loading sites, a relatively low level of research capability, the monitor system is faultiness, and the execution of laws is powerless…Therefore, at the present time, one of the most important errand for the researchers is to supply some feasible advices about the fishery management reformation to the government which could deal with those problems well. In order to accelerate the progress of the leading up to the QMS in China this paper provides an overview of the NZ QMS and give out some ideas.In the interest of achieving objects in above, the author use three research methods in the article: theory-based methods, compare-based methods and case-based methods. In this paper the author compared the fishery management system in being; analyzed the QMS especially the ITQs;expounded the New Zealand fishery management history before the transformation to ITQs, and problems encountered since its implementation, such as the progress for setting TAC,allocation of quota.The author sum up some advices after studying the QMS in New Zealand as follows:①Chose the Quota Management Areas (QMA) reasonably and we can first chose Bohai Sea as the tentative area according to the characteristic of China.②Manage the fish stock under an"Adaptive Management Plan"if we can not estimate the TAC accurately.③Provide partial quotas to the traditional village and manage it as the community fishing quotas (CFQs).④Allocate the quotas in terms of a percentage share of the TAC but not as fixed tonnage.⑤Quota trading should be simple, flexibility and accessible by all holder.Of course, this article has many limitations, for example, it refers less about the aspects of property right and the monitor system, otherwise, the advice which the author supply for Chinese is short and lack of pertinence. And I will pay more attention to those aspects in future.
