On The Land Expropriation System In China From The Perspective Of Responsible Government

In China, the land expropriation system was made in the background of the highly planned economy; it has not only intrinsically compulsory, but also high monopolization. This kind of system was accorded with the demand of the economic development at that time, and had played a significant role in that particular period. However, in the process of changing economy system, particularly with the accelerated industrialization and urbanization, the demand for construction land is rising rapidly, the system surroundings and service goal which the land expropriation system depends on had already transformed, its inelasticity and lag have become obvious day by day. As the result, the problems seriously affected the safe, stabilization and development of society; they had disadvantageous to the construction of the harmonious society. Therefore, China must carry on thoroughly reform of the land acquisition, and make scientific, reasonable and fair construction to our land expropriation system.It is helpful to optimize land resource disposition and protect the legal rights of farmers whose land has been expropriated and promote benign interaction between the government and farmers, thus promote the construction of harmonious society if the land expropriation system is scientific, reasonable and fair. This paper studies land expropriation system from the perspective of Responsible Government. In this paper, the evolution of the system is summarized, the essence and function of the system are cleared, and the intrinsic relations between Responsible Government and the system are systematically analyzed, then the defects of the system are emphatically analyzed from three aspects of the system idea, the system design and the system operation, and the causes of the defects are comprehended from system surroundings. Some viewpoints, which construct and perfect this system from the angle of Responsible Government, are put forward aiming at current problem, in order to play a consulting role to the land expropriation system to a certain extent.There are four chapters in this paper. Chapter 1 is an introduction, in this part, introducing the necessity, significance, purpose, research summarization, main contents, thread and structure, research methods, innovation and shortage of the research. Chapter 2 is the theoretical summarization of Responsible Government and the land expropriation system, mainly introduces some basic definitions of Responsible Government and the land expropriation system, and the intrinsic relations between them. Chapter 3 is the analysis of disadvantages in the current land expropriation system, and then finds the reasons why the defects make. Chapter 4 puts forward the countermeasures that our land expropriation system should be perfected in view of Responsible Government. Firstly, scientific development views should be established. Secondly, the concrete system of land expropriation should be consummated. It is significant to definite stipulations, particularly on the land expropriation power, in order to fully safeguard fanners' rights and property. Responsibility system should be perfected and duty performance - audited system should be established in order to regulate the land expropriation power. Thirdly, harmonious partnership between government and market should be set up in order to push the Market-oriented reform. Finally, it is imperative to construct Responsible Government and regulate the behavior of governments' land expropriation. The government role should be defined and the government function should be transformed. It is necessary to fulfill the government land expropriation responsibility in order to limit the government land expropriation power, and the reformation of land expropriation system can go well.
