Study On Land Tenure Dispute And Settlement Mechanism In Yueyang City

Land plays an important role in human survival and development. Along with economic development, the collision between human being and land resource is increasing. Land tenure dispute becomes more and more important to the harmonious society. The innovation on Dispute Settlement Mechanism of Land Tenure was the bedrock of this thesis, and Yueyang city is one of the experimental units. The present situation and reasons of land tenure dispute in Yueyang city had been analysized in-depth, Then achievements in this pilot project had been elaborated, and some advices had been given to solve the land tenure dispute well. The aim of this thesis was to provide the experiment reference to perfect the dispute settlement mechanism of land tenure. The following research results are as follow:(1) The concept, types and solutions of land tenure dispute had been summered, especially the good and bad points of the solutions, such as negotiation and mediation, administrative ruling and judicial decision. The rationale for the as follows analysising had been provide.(2) The present situation of the dispute settlement mechanism of land tenure in Yueyang city had been analysised from regional, phase, type and solutions aspects, Vicissitude of land tenure system; inadequate and irresolute application of the land policies; economic factors; run short of law and cadastral management confusional were main reasons which resulted in land tenure dispute of Yueyang city.(3) The dispute settlement mechanism of land tenure in Yueyang city had been elaborated, and it includes that theory achievements, practice achievements and .(4) These aspects should be ameliorated from the following aspects to make dispute settlement mechanism of land tenure better: Strengthening and improving the land legislative work; establishing and perfecting the land ownership archives administration system; accelerating urban and rural land registration certification and so on, According to circumstances correctly applying various mediate means.
