Research On The Problem Of China's Current Government Procurement

Government procurement is the behavior of purchasing commodities and service for the need of all levels governments holding daily government affairs and providing public service need ,which is according with the method and procedure in law.Government procurement system is the general name of a series of law, policy and system for government.Government procurement system, as the important system for government expenditure administration , is popular in western countries. Because of the principle of public, fair and equal followed by government and the scale benefit,the effect of it has been larger than the pure finance procurement administration, Which was involved in the macroeconomic regulation and control of national economy and the economic corporation field of in and out land.On June,29,2006,"The law of Government procurement of The People's Republic of China"was passed by the 28th meeting in the 9th the National People's Congress Committee. And which was proposed since January 1st,2003.Since"The law of government procurement of the people republic of China"was proposed 5 years ago,the government procurement activity have been into a new level. But at the mean time, there are a lot of problems, which restricted the deeper proposal of the government procurement system.This paper combine with the main problems in the government procurement practice ,give some suggestions for making government procurement system better. In the end, the paper give some outlook of the trends of China government procurement in the future.First part: Discuss the basic principle and concept of the government procurement, and the origin and development of it. In the end summarize the feature of the government procurement. Government procurement came out with the coming out of country. And it was modified step by step with the development of the social economy. Through the discussion of the basic principle and development of government procurement, it provide a foundation for the analyzing flaws in our country's government procurement. The second part: Pay attention on the main problem in the government procurement practicing and the flaws in the present government procurement system.A) It is not accurate for the limitation on the government procurement model. In order to push forward the procurement system ,the government set up central stock organization. So the right for stocking which is originally dispersed in every stocker. In the meantime, the government central stock organization administrate and modify it. But because the flaw of our nation's stocking model, project bidding company and all levels governments stocking organization utilize the same right. So the situation of the bidding companies with he aim of benefits and the stocking government with non-benefit aim take charge of the agency . Because the intermediaries attach to the public right department, take the right as stocker, and avoid the law supervision, the series of black case work were put on. And which make the image of government procurement worse in people's heart.B) After the government procurement finished, there are some nobody-supervision condition in the process of utilizing. The original aim of government stocking is saving resources and controlling cost. But some departments can not take good use of the resources, and bring bad effect to the government procurement work. When the departments apply for the stocking projects, almost all of them pursue brand, paying little attention on the real valuation of projects.C) Government procurement work is effected by the price, quality and efficiency. Under the marketing economy situation, price information is changing with the effect of many factors, such as marketing situation, time, and supply change. So it is not possible to get the fixed price. The key point is to pay attention on the suitable point when compare stocking price and the market. When purchase process, the product quality will be influenced by the restriction of purchasing capital, so we should not only pursue brands but not focus on the product quality. Government procurement should according to the methods in law and modified procedure. So it needs time for each purchasing project. But it will lean too much press on the purchasing organization work, and the organizations in all levels governments will face the problem to improve the efficiency. At the same time, because of the contradict feelings of he workers, the fighting from suppliers with the low quality and administrative intervention, our government procurement is limited in the development in a fluent way.D) There is not an entire and efficient check system for our government procurement. There are directly benefit relationship between finance departments and administer court. And there are benefit contradict among the law for the same supervision. So far the judicial examination can not ensure the object, fair and efficient check for the validity of the detail government action .So we can not protect efficiently for the right in law of the supplier.E) It is a little difficult for the dealing with the commercial bride in the government procurement field. The first point is the related laws are morbidity. And there is lack of the law proof for the deeper commercial bride dealing work. Second, the lack of system performance and self-restrict is another reason. Next, there is not enough punishment for the commercial bride behavior. In the end, it is another difficult point for the recognizing of the worst result of illegal purchasing.The third part: According to the problem exist in the government purchasing, we provide some suggestions as follows: First, we should strengthen the system construction, and improve the purchasing system. In order to modify the organization form, the law in our country must forbid the intermediate project bidding company take charge of the business of the government, or choosing some intermediate organization by public bidding. Second, we should strengthen democracy surveillance, modifying the government purchasing behavior step by step. We have some suggestions, for example leaders can give strong support for the government purchasing, and the National People's Congress Committee should check the executing for"The law of the government purchasing". At the same time, we should ensure the guide thought of surviving in service and develop in service. Third, we should strengthen the work in dealing with the commercial bride. First, we can set three defending line. And controlling in the beginning, middle and end of the event. Second, we should control the ten parts such as government budget, content working, plan controlling, contract making, approval , paying and so on. The last one is that we could pay attention on the punishment, construct credit system. The fourth point, popularized the network information technology, push forward the public of the government budget administration and purchasing work. Electronic government purchasing is the trend for the government purchasing development, which is the good way to promote the modifizations and improve the purchasing efficiency. Electronication is the method, and purchasing is the foundation point. Face to the people who do purchasing ,factory, supplier, and social public, electronication seize the creating point of electronic government and electronic business. In the mean time, we should focus on the preparation for the purchasing contract to enter WTO. The fifth ,we should work hard to improve the ability of the officials and purchasing workers. In order to improve the ability of government purchasing ,we should focus on the politics, principle, procedure and efficiency. In the mean time, we should compile bidding file, modify organization bidding, check contract,do the settlement and put files in order. The fourth part,look into the future of China government purchasing system, analyze the being six trend,such as scalization, polization, standarlization, electronization, incorrupt, and open purchasing.Concluding remark: There is deeper meaning of researching the improvement of China government system, push forward the government centralism standard procedure making, propose the improvement of its benefit and market system. And the government purchasing work act as the leading itself. And it can push forward the development of the whole government works.
