Problems And Countermeasures Of Trade Association's Function In Anti-dumping Cases

With the increasing of China's exporting to the outside, especially after China joined WTO, there are more and more anti-dumping cases that the Chinese goods suffer. During these cases, majority of them lost, from this has created the significant economic loss, also brought some tremendous adverse effects to the enterprise's development. These results have some huge relationship with the association's bad function in anti-dumping cases.On August 14, 2006, the department of commercial affairs"Stipulation in the answering of anti-dumping cases about Exports Products"officially executed. The new stipulation had established the"a four body"former which formed by the department of commercial affairs, the trade association, the enterprise and the local authority. The new stipulation has highlighted the association's function in anti-dumping cases, and this function would run through the whole process of answering of anti-dumping cases.Our trade association has already obtained certain results in the answering of anti-dumping cases. But compared with the anti-dumping cases our enterprises faced, the trade association's function was not enough. There are still some weakness about trade association's function. In the paper the author processed these question's reasons through consulting and analyzing massive materials.Strengthening our country trade association's function in encountering anti-dumping cases has very important meaning in reality and theory. Unifies the experiences of domestic and foreign trade associations in the answering of anti-dumping cases, the author believe that, we can strengthen the association's function in anti-dumping from the following several aspects:1. Establish the fund about the anti-dumping cases. The fund should be composed by three parts: pre-warning fund from the enterprises, the donation and government's finance supports.2. Establish the Anti-dumping pre-warning system. Unifies the experiences of domestic and foreign trade associations, the author suggested how to establish theanti-dumping pre-warning system.3. Strengthens trade association's autonomy function. The author suggested that the autonomy function should be based on the government's legislation and authorization, and the establishment of trade association'regulations.4. The absorption of person with anti-dumping abilities. The author suggested that there were three ways to absorb person with anti-dumping abilities: training, public employment advertise and establishment with related organization.5. Expand trade association's funds origin. The author offered three ways: the new profession association charge standard'formulation and government supports.
