Researching On The Institution Of Land Requisition Under The Theory Of Harmonious Society

This paper is researching on the institution of land requisition under the theory of harmonious society. The purpose of this paper is to explore the new institution of land requisition in socialist market economy and establish the harmonious requisition relationship; ensure the legitimate rights and interests of farms and maintain the development of national economic sustainable and stability; promote land expropriation to the market and the legal system. Based on Deng Xiaoping Theory and the "Three Represents" as the guide, the paper adhering to historical materialism and dialectical perspective, use the integrated analysis method, comparative analysis method and micro-macro analysis method to making the study.First, the paper gives a detailed explanation about the basic theories of the institution of land requisition and the harmonious society. It had explicitly pointed out the closed relationship between the institution of land requisition and the harmonious society. Through the contrast research about the institution of land requisition of overseas countries, the paper discovered some common character that could make some reference to our institution of land requisition. After the analysis about the historical evolution and present situation of our institution of land requisition, it had pointed out some existed defects about the current institution, such as: The scope of land requisition is not clearly defined; Land compensation was chaos; The main body of collective property was inexplicit and so on, furthermore, it had pointed out the hidden reasons related to legal, system and the interests. After the research of above questions, the paper proposed the thoughts of the reform on our institution of land requisition, such as: implement the basic policy of land; protecting the usage of land for economic development; protecting the legitimate rights and interests of farmers and the collective; the introduction of market mechanisms and so on. And then, it proposed the measures to reform, such as: clearly defined the public interest, to establish the scope of land requisition; strictly comply with the land requisition approval limits and procedures, protecting and controlling of the usage of farmland resources and so on.The institution of land requisition is one of the basic land management system, and the implementation of the institution is closely related to not only the economic construction and social development but also the interests of the most farmers and stability of the society. At last, through the example of reform of Xiamen Special Economic District, the paper have pointed out the important significance of the reform of institution of land requisition to the stability of the rural development and the construction of harmonious socialist society.
