Allegedly a deficiency of resource, water shortages is in essence an institutional deficiency. The only way out of water shortages is institutional innovation.As a kind of system, water right's purpose is to push on the economic growth and social development. With the shortage of water resource, the water right produced; and with the rareness aggravating, the water right changed. In our country, it is a kind of common right system arrangement that need the government to dispose water resource. Though a series of management systems implemented for over ten years and made the exclusiveness of water right improve to some extent, but the efficiency is relatively low.At present, the water right system of China is still in construction, the expected system performance has not displayed, and it needs further innovation. We should refer to the experience of foreign and domestic water right system, make clear of the defect of our system and set up the innovative system. Its core is that the water-saving incentive mechanism and the restriction mechanism of the water resources are formed by a kind of appropriate institutional arrangements. The market mechanism is introduced to the course of the water resources allocation by tradable system of water rights. Utilizing the strength on the market forming the water-saving incentive mechanism and restriction mechanism of water resources is a very good system choice to resolve the problem.In short, this paper analyzes the water right problem with the help of the relevant theories and methods of Institutional Economics; Applies Institutional Transition theories to investigate water right system transition objective inevitability; Applies property right theory to investigate the complexity and diversity in water right system transition process; Analyzes costs and incomes of water right system transition with the cost-income method. Thus demonstrates the possibility of Chinese water right system transitions .The analysis putting forward definitely that the government should change i ts working function in water resources disposing, guarantee the water right trade to carry out regularly, thus though the water market can we realize the disposition and using of water resources effectively...
