The Study Of Several Problems Of Safeguard Measures In International Trade

The safeguard measure is a very important exception clause in the WTO rule, also calls disclosure. It is "the safety valve" in the trade liberalization protecting the home industry. As the only legitimate protection method that WTO permitting, safeguard measures play the vital role in giving the member to carry on the industrial structure adjustment, reliving industry harm, maintaining the multilateral trade system. As China entering WTO, on one hand, the trade environment is fairer; the trade opportunity expands gradually, the possibility of frequent safeguard measure investigation increased. On the other hand, our domestic industries still lacking the international competitive power which needed us to utilize safeguard measure to protect the industry. Therefore, studying safeguard measure rule, grasping its present situation and the development tendency, constructing our country safeguard measure mechanism is supposed to be watershed.The full text is divided into five parts besides foreword. I drawing safeguard measures subject from the trade dispute of textile and clothes products of China, and elaborated safeguard measures theoretically about its intension and carry on the comparative study of safeguard measures and anti-dumping in order to hold the essence of safeguard measures in further. On this basis, through carrying on the effect analysis of economics, I plan to do more comprehensive understanding and define to the safeguard measures. Then I analyzed the positive, passive influence of safeguard measures in international trade, then summed up the application situation of the safeguard measures, and analyzed the development trend to make objective description and appraisal. Then describe the main safeguard measures systematically we met on the basis of preceding paragraphs. Combine and implement the typical case in recent years, I also analyzed the influence of the general safeguard measures and special protects to China's export trade. Probe the reasons that our country face and our main export products may meet with safeguard measures in the future. Last I develop two aspects of fully using the safeguard measures and protecting the domestic market, developing national industry, study further about how to build up industry security mechanism of our country in order to protect domestic industry and to deal with foreign countries under WTO frame.This text absorbs the existing research results extensively, and based on relevant theories of economics, using the relevant theories of international trade to carry on research synthetically. I hope to announce essence to the safeguard measures further through the exploration herein, and construct safeguard measures mechanism in order to have good guidance and reference to our country in using safeguard measures rule and protecting domestic industry.
