Analysis On Trade Safeguard Mechnism And China's Countermeasures

The term "safeguards" in GATT\WTO is generally used to denote obligation-avoiding actions of a member government responding to a contingent surge of imports that are deemed to injure or threaten to injure seriously the domestic industries of a product like or competitive with. Safeguard regime plays a key role stabilizing multilateral trade system, therefore is reputed as "safe value". Consequently, safeguard mechnism are attached more and more importance by WTO members as a kind of powerful trade instruments, which contribute to relieve industrial injuries and equipoise trade interests.By comparison with other measues of trade safeguard, Safeguard regime bears the features as follows: (1) Justice. Because of this feature, the rival can revenge by the same method. (2) Strict. This mainly focuses on the strict process. (3) Flexibility. The ambiguous description for concept and criterion leave room for the abuse of this measure.China's accession into WTO signifies overall participation in world economy. All aspects of our domestic economy are confronted with rare opportunities or unprecedented challenges. Safeguard mechnism lie at the heart of the problems. On the one hand, aggrandized market opportunities probably result in more frequent safeguard investigations taken by other WTO members. On the other hand, many domestic industries, which lack international competitiveness, require perfect safeguards regime to protect them from the impacts of foreign goods. Therefore, the subject of this dissertation, i.e. safeguards, is of great significance.The researches made by the most of the scholars in foreign countries and domestic are mainly on the Safeguard regime itself as a two-side sword because of its advantage that enough time is given to the appliers to prepare the weak industries for international competition and the disadvantage that too much protection will destroy the relative industries at all.Through so much hard work for the analysis of the research fruit existed, my paper aims to provide constructive suggestions to the reality of our country .
