The Research On The Legislation Of The Medical Insurance For Urban Residents In China

The medical insurance for urban residents is one important part of social security system, it effects the essential interests of urban residents. However, legislation lags led to medical insurance for urban living unclear legal status, legal protection is not perfect,making China's urban residents in the development of medical insurance has been severely constrained. The present thesis analyzes the necessity and feasibility of medical insurance legislation for urban residents and the present legislation condition in China which attempts to make some contribution to the medical insurance system for urban residents.The thesis is divided into four parts:The first part is the legal concept of medical insurance for urban residents and the analysis of nature. Medical insurance for urban residents has both the nature of medical insurance, but also the nature of social insurance, and thus the legal nature is the social health insurance.The second part analyzes about urban residents'medical insurance legislative status and the main problems. These parts first review the medical insurance system for urban residents in China's history, then describe the legislative status quo of medical insurance for urban residents, and analyze existing legislation there are problems at last. There are: the legislative problems in the overall mechanism; the principle of legislation, targeting problems; specific law problems.The third part analyzes the necessity and feasibility about the legislation of medical insurance legislation for urban residents. First, this part analyses the necessity for legislation from the following three aspects: one, it is to clear the legal status of medical insurance for urban residents; two, it is to regulate health insurance for urban residents in order to run the legal system; three ,it is to enhance the psychological on health insurance for urban residents. Then this part discusses the feasibility of legislation. That is, inspiration and learn from foreign experience, a prerequisite for the existence of legislation, experience from legislate.The fourth part is legislation research in medical insurance for urban residents. This part mainly includes three aspects: first is how to improve China's legislative framework of medical insurance for urban residents, which is to provide legislative proposals to the legal system, the legislative level, and Legislative Concept; second provides proposals for medical insurance for urban residents in legislation basic principles and Legislative goals. Third makes legislative proposals for rights and obligations of the urban residents, management of insurance Fund management and legal responsibilities.
