Government procurement system was formed in capitalist countries, around the 18th century. It has a history of more than 200 years. More and more countries cry up this system because of its effect on the economical finance, macroeconomic control, optimizes the industrial structure and promoting clean government, and so on, China introduces an experiment of government procurement system in selected place in 1996. We enact the"The People's Republic of China Public Bidding", "The People's Republic of China Government Procurement Law" and some other regulations in these years. They help the embryonic form of this system to be constructed in China."Agreement on Government Procurement" of WTO is a very important part of international government procurement rules. It becomes to the major government procurement regulation in many developed countries and some developing countries. China promises to enter into GPA when it became a part of WTO, and officially joined into GPA negotiations at the end of 2007. We also submit a preliminary bid list to WTO after that. We are trying to get the promises implemented, but it was prevented by many other factors. So it will be a long time to enter into the GPA.Entering into the GPA is a choice with both opportunities and challenges to China. This is an opportunity to perfect our Government Procurement system, and also an opportunity to converge with international Government Procurement rules. What's more, Chinese Government Procurement market open to the world can promote the establishing and perfecting the public market system in China. However, enter into GPA has some requirements for Chinese government, too. It requires the government to modify the domestic legislation to match the relevant provision of the international Agreements, and also requires China to open the Government Procurement market to the world. This will have some impactions on domestic economy and international trading in China. The task for Chinese government is to conclude the strength, weakness and also the lessons from the practical work of its Government Procurement system. We also should study the differences between the"GPA"specific rules and Chinese Government Procurement regulations. Then we can make use of the agreements related to special treatment and some transitional actions for developing countries, to achieve the integration with international Government Procurement rules."GPA2006"was effected before China join the negotiation, so we should enter into this negotiation adhere to the latest version of agreement. We also should construct the Government Procurement system in according to the frame work of"GPA 2006".First of all, we should re-commentate on the function of Chinese Government Procurement system in the new circumstance. In the past 20 years, Chinese government only focuses on its effectiveness of the economic and clean government. Therefore, its function of policy leading is not fully played. Chinese government should make its policy leading functions be well played, in order to establish a modern Government Procurement system.Secondly, we should implement the principle of consisting the domestic legislation and the practice with the agreement. Make it clear the relationship between the principle of domestic products priority and the principle of non-discrimination. And also implement the principle of policy transparency.Thirdly, the leading position of state-own enterprise in Government Procurement system should be ondered. Finally, China should not ignore the importance of innovation on procure ways and perfecting the principle of challenge and complaints.
