With the continuous advancement of technology, competition among enterprises has turned to the competitive of technology from competing products. Patents, as a kind of technology protected by the relevant law, is so important for survival and competitiveness of enterprises. It can help businesses gain a larger market share and has gradually become a tool of competition between enterprises. More and more enterprises compete on the patent in a fierce market competition. In recent years, the total amount of patent is increasing. But the rate of patent commercialization is very low. A large number of patented technologies have not been implemented and this has resulted in waste of resources. How to promote the commercialization of technology patents has become t one of the problems to address.In this paper, we studied the timing of invention patent commercialization under uncertain conditions. We constructed an analysis model for investment opportunities of invention patent and solved the optimal timing of investment. We analyzed the effect of o market uncertainty, competition, first-mover advantage and so on. The results showed that the timing of invention patent commercialization is proportional to market uncertainty and risk-free interest rate under monopolistic market conditions. But it is inversely proportional to the waiting cost. In the duopoly market, game equilibrium in two ways:sequential equilibrium and co-investment balance. Equilibrium outcome of the game depends on the initial state of State variables. The increase of first-mover advantage has a positive effect on the investment value of the leader but has a negative impact on the investment value of the followers. The Positive impact is greater than the negative impact.This article is divided into six parts. The first part mainly describes the background of this study, the significance and research ideas and research methods. The second part is literature review. The third part analyzes the characteristics of patents and influencing factors. The fourth part is the model and analysis of the results under the monopoly of the market. The fourth part is the model and analysis of the results under monopolistic market conditions. Part VI is the conclusion, this section includes the main conclusions of this paper, and lack of innovation and future research were discussed.
