The Study Of Peasants' Interests Security In Rural Land Tranference

China's large but per capita is small; The contradiction between people and land is very sharp. This is China's basic situation. The Household Contract Responsibility System, which was implemented at the beginning of 1980s, has really improved the rural economy at that time and mobilized peasants'activities. But as the development of market economy, great changes have also happened in rural area. While the contradictions of small-scale operation of rural land and repeat installation of resources is getting more and more serious which could not be ignored.Land-transfer has improved the utilizing efficiency, laid the foundation for scale operation of rural land and gotten quick development in rural area. Land-transfer modes are diversifying, from simple rent and sub-contract to nearly perfect inverse rent and land shares. Especially in recent years, with the development of urbanizing process, land-transfer in rural area is becoming increasingly active. While there forms an increasingly reasonable land-transfer mode, there also exist violations of the rights and interests of the peasants, which has violated the ownership of peasants. This paper mainly analyzes these violations of the rights and interests of the peasants in land-transfer process, and explores how to protect the right and interests of peasants in the current transfer mode.Focusing on the land-transfer and protection of peasants' right and interests, firstly, this paper simply introduces the meaning of this researching task, the relevant basic theories, the system of rural land-transfer during current period and the existing rural land-transfer modes, analyzes the influence of these modes on the right and interests of peasants.Secondly, there appears different using entities in the land-transfer process, including rural land mainly used by foreigners, rural land mainly requisited by government, rural land mainly used by rural collectives and land-transfer self-initiated by peasants. Different usages by different using entities cause different changes in the right and interests of peasants. This paper analyzes the change of the right and interests of peasants when the land is used by different entities. Then it introduces different entities chosen for protecting the right and interests of the peasants, which indicates that protection of the right and interests of peasants can be conducted from different perspective.Thirdly, this paper introduces the infringements of the peasants in the land-transfer process, including operating irregularities in land-transfer and the violation of peasants'right, the change of usage of rural land and un-insurance of peasants'interests, shortage of basic life necessities causing by low compensation for land-requisition, violation of peasants' collective ownership of land, non-access to complain because of imperfect law and regulation. Then this paper probes the reasons for harming peasants' right and interests and different identity choice for protecting peasants' right and interests. It wants to elaborate this on three perspectives:government, villagers' committees and peasants'themselves.Last, this paper offers some suggestions on protecting the right and interests of the peasants, including the optimization of land-transfer-mode, perfection of social insurance system, improvement of rural land-transfer market and encouragement of developing rural community organizations.The protection of peasants'right and interests relates to the orderly operation of rural land-transfer. It has attracted the attentions of the central government and the academic community. Under the unrelenting effort of people from all circles of life, we believe that the protection of peasants'right and interests could be carried out and the rural land-transfer can be developed in a healthier environment.
