Study On Establishment Of China Urban Management Law Enforcement Supervision System

On 17 March 1996, the Fourth Session of Eighth National People's Congress adopted the "PRC Administrative Punishment Law", whose Article XVI established a relatively concentrated administrative punishment system. After the confirmation of the relative concentration administrative punishment by of State Council Legislative Affairs Office in July 2000, urban administration and law enforcement teams has been established and playing a big role in city management. Since the redistribution of responsibility and power previously owned by related bureaus, the efficiency and level of law enforcement have been greatly enhanced, disadvantages of original lack of enforcement under the politic system has been solved effectively, thereby, the importance of urban administration and law enforcement teams become widely recognized by society. At the same time, shortcomings of those teams in theory and practice also increasingly become apparent and questioned by the masses. Criticism on the teams are soaring such as the low personal quality, non-unified enforcement, inappropriate method and violence, the masses increasingly request improvement of supervision on the teams. Obviously the urban management law enforcement is under exploration and to be improved and reformed, but a powerful supervision system is also urgently required because the enforcement relates closely with the mass benefits, otherwise, difficulties existed in law enforcement will continue and prestige of our government will be decreased. Work of the Teams in Zhuhai city has been carried out for almost 10 years. As a Special Economic Zone and the National Health City, there would be definitely higher demands on the level of urban law enforcement and supervision in Zhuhai. Targeted establishment of scientific and valid supervision system could not only help to standardize and improve law enforcement of Zhuhai city management, but also is necessary to build a harmonious society and create a felicific Zhuhai.Using a combination analysis in theory and practice, considering theory of public management , administrative and urban management , this paper discussed the background of urban management law enforcement system and the necessity and importance of building the supervision system; Concerning the problems, such as the principal of inside lack of independence, the outside dispersed, unclear supervision procedure and faulty methods. Taking example by successful and effective methods in other Chinese cities and foreign countries, this paper discussed using administrative supervision, legality establishment, e-government even more elements in the urban management enforcement supervision system. And further analyzed several methods such as the internal"big city management", dedicated supervising team and public scrutiny; in the system improvement aspects, this paper focuses on importance of the unity of urban management and law, participation system and administrative review to the Enforcement; For the procedures and methods parts, it mentioned regulatory framework of taking the area ownership management first under unified regulation, combining the site supervision and off-site supervision. For the method aspects, establish digitalized internal supervision network and normal monitoring platform. Meanwhile, in order to maximize the effect of every dominant elements in urban enforcement supervision, coordinate resources and conform to technology trends, the paper raised a conception that using informationalized platform to build an integrated supervision system, and stated analysis on the feasibility, effectiveness, and issues we should pay attention to, so as to achieve the complete establishment of supervision system on urban management law enforcement.
