Research On Development Of Product Liability Insurance

With the aggressive development of economy and international trade business, particularlythe result of the globalization of world economy, lawsuits filed against domestic or foreignproduct liability is on an increasing trend. Since the process of establishing a national productliability legal system progressed comparatively slowly, it rendered the national situation ofprotecting customers' interests and spreading manufacturers' risks negatively passive.Consequently, customer protection and risk spreading for China's manufacturer and productdistributor constitutes a critical subject requiring proper solution, during the process of economicand legal system construction. Definitely product liability insurance is the solution to this issue.But at present, our country' product liability insurance' market share and growth rate are wellbelow level of developed country and average of the world, it is an important problem which theinsurance faces at present how to realize the fast development of the product liability insurance.Based on lots of documents, this paper gives systematic analysis of the problems in thedevelopment of product liability insurance, and gives some suggestions on how to developproduct liability insurance in China. This article is divided four chapters. The first part introducesthe law basic of product liability insurance and makes analysis on its economics characters.Chapter Two analyzes current development of product liability insurance in China, finds therestriction factor and analyzes the reasons. Chapter Three tries to find defects in our country'product liability insurance through the developed countries' advanced experience. Chapter Fourformulates some feasible development tactics to develop our country' product liability insurance.Through presentation of the subject topic, this thesis is intended for generating and calling uponthe attentions and enthusiasm of those concerned, committing them to develop china's productliability insurance.
