Nowadays, the application of electronic exchange based on the internet is mounting in our daily life. Accordingly, the net disputes increase dramatically both in the civil and criminal area of justice. The value of digital signature, as special electronic evidence, is that it can provide judging criteria for electronic data's authenticity through forensic identification. The thesis, combining digital autograph's technical principles with up-to-date judicial cases and legislation in China and abroad, puts forward that the judicial and forensic identification system for digital signature should, on the basis of digital signature technology, make its neutral judgments on the origination of electronic data in order to distinguish the effect of digital signature. On the establishment of forensic identification system for digital signature, the thesis holds that, by means of building a reliability rating system, we can successfully set an operational mechanism, which is analogical to identification of traditional signatures and ordinary electronic evidence. In the last part, we provide an emulation process of the signature identification based on the RSA signature scheme. |
