On The Applicable Rules Of GATT Article 20 Environmental Exception Clause

As the environment and natural resources protection are more becoming the common concerns of the international communities, every country holds new requirement on the balance of the world trades and environment protection. Invoking environment exception clauses the GATT1994Article20is the suitable choice for the WTO members who want to qualify their measures under the rules of WTO. The Article20environment exception clauses consist of the Preamble, the (b) and (g) clauses. The overall structure of this thesis is:Firstly, analyze the overall meaning of GATT1994Article20.Secondly, conclude the interpretation methods employed by DSB of (b) and (g) through investigation on the DSB interpretation history. And finally, while analyzing the applying principle of the GATT1994, give advises on how to make a balance between the Chinese civil legislation and WTO rules for China.
