An Analysis Of Several Problems In The Investigation System Of Duty Crime In Our Country

Duty crime is a serious corruption. In China, the procuratorial organ is the legal organ to investgate corruption crimes. In order to meet the needs of investigating duty crime, the prosecution in the judicial practice gradually formed a preliminary investigation of duty crime.Preliminary investigation of duty crime is of important significance for the protection of human rights and case quality.Especially with the new "criminal procedural law" carrying out, the law puts forward higher requirements and challenges to preliminary investigation of duty crime.The basic position of preliminary investigation of duty crime in the crime investigation work is more prominent. However, in the actual case of the procuratorate, due to various reasons, the preliminary investigation appeared many problems. It has seriously affected the detection of preliminary investigation of duty crime case. Based on the analysis of preliminary investigation of duty crime’s concept, nature and development process, this thesis puts forward some problems of our preliminary investigation system existing in the real operation, such as the single means, the confusion of clues management, the unclear legal status of the preliminary investigation system and the lack of effective supervision and relief system. And then I put forward reform measures on the preliminary investigation system of duty crime to perfect China’s duty crime investigation system and I hope it works more effectively for the procuratorial practice.This thesis is divided into three chapter.The first chapter is about the theory of preliminary investigation of duty crime.The second chapter is about some problems in our preliminary investigation of duty crime.The last chapter is about ideas to improve China’s preliminary investigation of duty crime.
