Research On Several Legal Problems Of Perfecting Construction Supervision System In China

Construction project supervision and management system，is based on the traditional twodimensional project construction management model of building and construction.Through the development of appropriate institutional regulations, to transform it into theinterrelated and mutual restrained three dimensional management model of building, constructionand supervision. In China, the original Ministry of Construction published <the notification ofconstruction projects supervision and management> back in1988.forward the implementation ofthe construction project supervision and management system and its gradual extension throughoutChina.In1997, the <construction law> was promulgated, for the first time in China theconstruction supervision and management system was regulated via legal system.Subsequently,the former Ministry of Construction and other relevant departments have gradually put forwardregulations and policies in relation to the construction supervision and management system.All ofthese have built up the legal system for Chinese construction supervision andmanagement.However, it has not been long since construction supervision and management havebecome an important institution in the construction industry in China.As one of the important legalregimes established during China’s early reform period, this contruction supervision andmanagement system was based on the advanced foreign construction experience and internationalconstruction project management model.The standards and investments of China’s projectsconstruction have achieved positive social benefits.However, with the continuous development ofeconomy, particularly in recent years，China’s construction market has experienced unprecedentedprosperity, followed by frequent construction accidents due to quality issues， disputes betweenparticipating parties have been nonstop.There are multiple reasons that coursed this situation,including the unsound factors within the construction supervision and management system itselfas well as issues relate to its implementation.This thesis is based on the current status of China’sconstruction supervision and management system, combined with legal theory, to look at China’scurrent legislative environment, its issues and aspects of international practice models andsupervision system.Hoping to contribute to the development and improvement of China’sconstruction projects supervision and management system through theoretical and practicalaspects.This thesis analyzes China’s supervision and management system by combining theory andpractice, focuses mainly on the following sections:The first section analyzes the current status ofChina’s legislation system for construction supervision and management and the issuessurrounding construction supervision and management, including its legal status, responsibilities,regulatory mechanisms, risk prevention mechanism, and industry association managementmechanism;The second section analyzes the foreign construction project management model andhow it could be used as reference to China’s construction supervision and management system.
