A Study On The Infringement Of Covering Musical Works

With the rapid economic development of modern society, people’s wallets isgrowing bulge, while also the rich spiritual life, entertainment and enjoyment ofnature included. In recent years, the phenomenones of musical works occurrefrequently.However, with the development and implementation of intellectualproperty law, the copyright protection awareness of the community have even moreenhanced. Musical works rights holders for their work have had much "off-label"consciousness.When in the face of violation of their legitimate rights from users,theholders have much more choices to pick up the legal weapons.However, in recent years the number of infringements of musical works hasincreasd. Tort finds of musical works also expose many problems. This paper mainlydiscussed on several existing cover in the form of expanded musical works for thecover of infringement issues. The full text divided into four chapters of this problemis studied.The first chapter is on the cover of musical works and popular definitions cover thecauses and types of cover discussed. Clear the legal concept, the cover tells the mainpopular factors,and musical works are distinguished.The second chapter will cover the legal basis for the legitimacy of musical works,tort definition of the problem as well as a cover of tort liability problems caused bythe commitment of a detailed study. On the cover of several forms of infringementwere analyzed to define the problem, and in each case the liability was to be borne bythe infringement.The third chapter is mainly on the status of foreign musical works protected,pointing out the conservation status of musical works fairly representative of theUnited States of America and Germany from the legislative level to copyrightassociations and other parties operating mechanism, in order to be able to work to areference guide to protect our current musical plays.Chapter IV presents Construction of music copyright protection system. First,it pointed out inadequacies in our music copyright protection, and then put forwardsome suggestions to improve the protection of music copyright.
