The development of digital technology and network communication technology changed the way of transmission of musical works. The network is increasingly becoming the main source of people access music. At the same time, it brings the issue that the infringement of musical works on the network are flooding increasingly. Owing to the characteristics of the network itself, causes the traditional system of copyright protection not able to protect it effectively to balance the interests among the copyright owner, the disseminators and the users. And this impacts the created enthusiasm of the copyright owners seriously, is not conducive the development of online music rapidly and healthily. Therefore, the study on the musical infringement in the network environment has very important and practical significance.This article starts with the typical case of Kirin Tong company's Litigation Against Yobo company with the copyright of the related songs in the "xueyuguangmang" album. Combine with the exist problem of china's musical copyright protection in the network environment and the focus of controversy in both sides. According to the actual situation of china, make some systemic and operational recommendations to perfect the legislation and related systems of china's music copyright protection in the network environment. This article is divided into three parts:The first chapter introduces the case Beijing Chao yang District People's Court accepted of Kirin Tong company's Litigation against Yobo company with the copyright of the related songs. In the second Chapter, analyzed the exist controversy focus in the trial combined with related laws and regulations. In the third chapter, analyzed the shortage of china's laws and regulations in the problem of music copyright protection. Finally, based on this, we made some recommendations.
