Legal Protection Of Privacy Right In China 's Network Environment

With the rapid development of network technology, the privacy is not confined tothe traditional realistic life. Issues related to personal privacy have been extendedfrom the real life to the virtual space of network. According to the “33th ChinaInternet Development Statistics Situation Report” which released by2014JanuaryChinese Internet Information Center, Chinese netizens reached6.18billion by the endof2013, which included5358million new Internet users. The Internet penetration rateis45.8%and rose to3.7%compared to the end of2012.The wide application ofcomputer network and the development of information technology andcommunication means make profound changes in every field of society, and provide agreat convenience to people’s study, work and life. But at the same time the networkspread quickly and widely, also result in increasing the risk of abuse, illegaldissemination and modification the personal data. At present, under the networkenvironment violation events occur frequently, people’s privacy is constantly underthreat, but also restricted the development of network and the related industry. Itbecomes a problem urgently to be solved how to protect the right of privacy under thenetwork environment, and maintain the normal, healthy development of network.It has become a highly concerning problem how to protect the privacy under thenetwork environment. Because network development starts lately in our country andthe people’s consciousness is weak, the researching and protection of privacy underthe network environment is not as good as Europe and the United States and otherdeveloped countries. We should refer to the foreign advanced experience and practice,combining with the actual situation of our country, and carry out effective protectionto the privacy under the network environment in China.This thesis mainly analyzes the concept, content, characteristic and infringementbehavior of the privacy under the network environment, and points out the necessityof the protection of privacy. Then we compare the United States and European Unionin privacy protection mode to our country under the network environment, based onour national condition, and put forward the existing problems and the measures of improving our country’s privacy protection under the network environment, in orderto protect people’s privacy better and promote the healthy development for thenetwork and the related industry.
